Help the dog fly is a platform which aims to connect transport volunteers (Volunteer) and animal lovers with Pet parents of animal that need to be transport from one point to another to be reunited with their family (Pet parent).
(collectively, the Services.)
The Services are accessible at www.helpthedogfly.com (Site).
By using the Site or Services, you agree to comply with these Terms and Conditions and to be legally bound by them and by our Data Protection Policy (collectively referred as Terms), whether or not you become Volunteer or Pet parent. Any use of the Site is governed by the Terms.
The site enables Volunteers and Pet parents to connect. You agree that Help the dog fly is not a party to any agreements entered into between Volunteer and Pet parents nor is Help the dog fly a travel agency, an agent or an insurer. Help the dog fly do not monitor the Volunteers and Pet parents and disclaims all liability in this regard.
Eligibility
Help the dog fly aims at connecting adults over 18 years old any use of the Site by anyone under 18 is expressly prohibited. By using the Site or Services you expressly warrant that you are an adult over 18 years old.
No Warranty
Help the dog fly does not warranty any Listing Trip (as defined below in article 3) or reward. You understand that the pictures on the Site are for information only and in the responsibility of the Volunteer and Pet parent.
You acknowledge that in case you would seek any legal remedy for actions or omissions of Volunteers or Pet parents, or any third parties, you will not claim any liability against Help the dog fly.
How Help the Dog Fly works
Pet parents can register with Help the Dog fly for free to create a listing that describes the type of travel needed for their animal (Destination, dates and possible reward) (a “Listing Trip”)
When a Pet parent is registered, Volunteers are able to contact the Pet parent through the Site.
Although Listings Trips can be viewed without registering, Pet parents and Volunteers must create an account to be able to contact each other.
Volunteers would be able to:
Create a profile, upload photos, read feedback, leave feedback;
Contact Pet parents;
Be contacted by Pet parents;
Contact other Volunteers;
Contact Volunteers regarding feedback;
Access to human help-desk support.
Verify their identity.
Human help-desk support does not constitute a guarantee that your problem will be solved but only a commitment from Help the dog fly to try to provide you with helpful information
As stated above, Help the dog fly is not a party to any agreement between Volunteers and Pet parents, neither is Help the dog fly a travel agency, an agent or an insurer.
Volunteers Registration and Obligations
When registering as a Volunteer, you agree and confirm that:
You are responsible for your own account security and you will not share your account details with any other person;
You are over 18 years old, or if different, the age of legal majority in your jurisdiction;
You will use your real name, address and contact details;
All other information you provide will be accurate and true;
You already purchased your way to transport (flight, boat, train) or you have plans to do it.
Any Pet parent with whom you accept to collaborate will genuinely benefit from your help.
As a registered Volunteer, you acknowledge that:
Help the dog fly is a platform and service for contact. Your suitability will depend on the profile you write. We are not an agency and we do not guarantee that you will find a suitable Pet parent; Though we are available to help and provide advice.
You are using Help the dog fly entirely at your own risk and we expressly exclude all liability for any loss or damage you, your family, your reputation, your business, your travel plans or your property may suffer as a result of using Help the dog fly;
Help the dog fly do not screen the identity of any Pet parent and you are solely responsible for ensuring that any person you accept is who they say they are;
You are solely responsible for complying with the relevant rules and conditions with the flight, train or boat company.
You are solely responsible for complying with the check-in of the animal under your name once the agreement with the Pet parent has been made.
You are solely responsible for complying with the relevant rules and laws in your jurisdiction (if any) especially with regard to tax, insurance and visas.
You will keep your Listing up to date, and if no longer valid or required, promptly update it or remove it from the Site.
As part of your Listing, you are required to upload a photo of yourself. When doing so:
You grant us a non-exclusive, transferable, sub-licensable, royalty free, worldwide licence to use that photo on your Listing and elsewhere on or in connection with Help the dog fly; You warrant that it is your own photo and our use of the photo will not infringe the rights of any other person.
As stated above, you acknowledge that Help the dog fly is not set up to provide or replace travel opportunities. It is your responsibility to define and comply with this. Help the dog fly will remove or edit your Listing if we believe (in our sole discretion) that it infringes or violates another person’s rights or any laws in any country.
Pet parents Registration and Obligations
When registering as a Pet parent, you agree and confirm that:
You are responsible for your own account security and you will not share your account details with any other person;
You are over 18 years old, or if different, the age of legal majority in your jurisdiction;
You will use your real name, address and contact details;
All other information you provide will be accurate and true;
Your pet’s information and photo will be shared publicly both on social media and on the website.
You acknowledge that:
Help the dog fly is a platform and service for contact. We are not an agency and we do not guarantee that you will find a suitable Volunteer; Though we are available to help and provide advice.
You are using Help the dog fly entirely at your own risk and we expressly exclude all liability for any loss or damage you, your animal, your family, your reputation, your business, your travel plans or your property may suffer as a result of using Help the dog fly;
You are solely responsible for complying with the relevant rules and laws in your jurisdiction (if any) especially with regard to animal’s paperwork, transport, tax, insurance and visas.
Though we actively encourage it we cannot guarantee that any Volunteer you contact after registering will respond to your query or be available at any particular time or on any particular dates;
We do not screen the identity of any Volunteer and you are solely responsible for ensuring that any person you accept is who they say they are;
You are fully responsible for investigating whether your chosen Volunteer and opportunities they are offering are suitable for you and your needs;
Help the dog fly reserves the right to remove and terminate any account without warning.
 Volunteers and Pet parents conduct
By using the Site and Service you agree that you are solely responsible for compliance with any law, rule, regulation, that may apply to your relationship with any Volunteer, Pet parent or any third party. You acknowledge that you will not:
Violate these Terms, any law or regulation, or any order of a court
Use the Site or Services for illegal purpose, especially to breach violate Help the dog fly Data Protection policy or Terms;
Use the Site or Services for commercial purpose or other purposes that would violate the Terms or any law;
Imply in any way any partnership between Help the dog fly and you or any endorsement or affiliation with Help the dog fly;
Harm in any way Help the dog fly’s reputation, brand or image including through unauthorised use of the Site or Services, infringement of Help the dog fly’s intellectual property rights, passing off, registration and/or use of Help the dog fly’s domain names, trademarks or logos or any other identifier that would create confusion with Help the dog fly or imply a connection with Help the dog fly;
Harass any Volunteer or Pet parent or collect or store any personal data about them other than for purposes of the Service or engage in any abusive behaviour;
Offer a Volunteer an opportunity to travel without any permission or authorisation or submit any Listing with false or misleading information;
Register for more than one Volunteer or Pet parent account or register for a Help the dog fly Account on behalf of an individual other than yourself, or falsify or misrepresent yourself;
Recruit or solicit any Volunteer or Pet parent to join third-party services or websites that are competitive to Help the dog fly, without Help the dog fly’s prior written approval;
Send the same text to multiple members via the messaging system. This is considered spam. There are automated filters which can detect if these types of message are being sent which can lead to messaging being suspended on any account where this is detected;
Use any software or devices to access in any way any authorized web pages on the Site or attempt to harm, decipher, decompile any of the software used to provide the Site or Services;
Damage the Site or Services, including, through the use of viruses, Trojan horses, forged routing or electronic mail address information or similar methods or technology;
Collect or retrieve data from our Site to compile, directly or indirectly, a collection, database, directory, or otherwise
Encourage, promote or assist any third party in doing any of the foregoing.
Help the dog fly reserves the right, without prior notice and at any time, (i) to remove or disable access to the Site or Services at its sole discretion, in case of violation of the Terms; (ii) to investigate and prosecute any violation of the Terms (iii) to disclose any of your information if required to do so by law.
Misconduct
If you feel someone is violating the Terms and acting inappropriately, you should immediately report such person to the appropriate authorities and then to Help the dog fly.
If an account has been removed, terminated it is not possible to set up a second account.
Safety
You acknowledge that you have read and understood our Site safety guidelines and that Help the dog fly is not, in any way, responsible for guaranteeing the safety of any Volunteer, Pet parent, animal or any person associated with either of them.
Privacy
By using the Site and Service you agree that Help the dog fly’s Data Protection policy governs Help the dog fly’s collection and use of your personal data and information.
The Data Protection may be updated by Help the dog fly from time to time.
Miscellaneous
You agree to indemnify Help the dog fly against any claims, actions, proceedings, losses, damages, expenses and costs (including without limitation court costs and legal fees) arising out of or in connection with your use of Help the dog fly.
Help the dog fly may contain links or references to third party websites. Any such links are provided for your convenience only. We have no control over third party websites and accept no legal responsibility for any content, material or information contained in them. The display of any link or reference to any third party website does not mean that we endorse that website, product or service.
You acknowledge that Help the dog fly is a service to enable contact and does not act as an agent or is party to any exchange you organise.
We may modify the Terms from time to time. You agree to be bound by any changes made by us. It is your responsibility to check the Terms from time to time to verify such changes.
These terms are governed by United Kingdom law and any disputes which might arise between you and us in relation to Help the dog fly will be heard in the exclusive jurisdiction of the United Kingdom courts unless we both agree otherwise.
